1) is entered in the register with the authority competent for the registration of business entities;<\/o_p><\/span><\/p>\n

2) has duly fulfilled all its tax and social security contributions obligations in accordance with the law, or the regulations of the state in which it is established;<\/o_p><\/span><\/p>\n

3) prove that he or his legal representative has not been convicted by a final judgment for any of the criminal offences of organised crime involving corruption, money laundering and fraud;<\/o_p><\/span><\/p>\n

4) has a permit, licence, approval or other authorisation to carry out the activity that is the subject of the public procurement, if this is required by a special law.<\/o_p><\/span><\/p>\n

<\/span><\/p>\n

The conditions of paragraph 1 of this point do not apply to natural persons: artists, scientists and cultural creators.<\/o_p><\/span><\/p>\n

Proof of compliance with mandatory requirements<\/o_p><\/span><\/b><\/span><\/p>\n<\/div>\n

<\/span><\/p>\n

Compliance with the mandatory requirements is demonstrated by providing:<\/o_p><\/span><\/p>\n

<\/span><\/p>\n

1) proof of registration with the competent authority for the registration of business entities, with details of the bidder's authorised representatives;<\/o_p><\/span><\/p>\n

2) a certificate issued by the tax authority confirming that all tax and contribution obligations have been duly declared, calculated and paid up to 90 days prior to the date of the public tender opening, in accordance with the regulations of Montenegro, or the regulations of the country in which the tenderer is headquartered;<\/o_p><\/span><\/p>\n

3) a certificate from the competent authority issued on the basis of the criminal record, which must not be older than six months as of the date of the public opening of bids;<\/o_p><\/span><\/p>\n

4) proof of possession of a valid permit, licence, approval, or other act issued by the competent authority, namely:<\/o_p><\/span><\/p>\n

<\/span><\/p>\n

A company, a legal entity, or an entrepreneur, in accordance with the opinion of the Engineering Chamber of Montenegro no. 01-3200\/3 of 28.07.2016, should hold licences for:<\/o_p><\/span><\/p>\n

-          <\/span><\/span>Preparation of topographical surveys, reports and\/or projects;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Preparation of geotechnical projects, reports and\/or designs;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>The design of structural engineering projects for high-rise buildings;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Conducting surveying work;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Execution of geotechnical works;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Carrying out construction and building trades work on high-rise structures.<\/o_p><\/span><\/span><\/p>\n

<\/span><\/p>\n

The supplier, i.e. the company, legal entity or entrepreneur, must have engineers on its staff who hold licences for:<\/o_p><\/span><\/p>\n

-          <\/span><\/span>Preparation of topographical surveys, reports and\/or projects;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Preparation of geotechnical projects, reports and\/or designs;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>The design of structural engineering projects for high-rise buildings;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Management of surveying works;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Management of the execution of geotechnical works;<\/o_p><\/span><\/span><\/p>\n

-          <\/span><\/span>Management of the execution of construction and building trades works on high-rise structures<\/o_p><\/span><\/span><\/p>\n

\u00a8<\/span> statements regarding the educational and professional qualifications of the bidder, the qualifications of management personnel and, in particular, the qualifications of the personnel responsible for carrying out the specific works;<\/o_p><\/span><\/span><\/p>\n

\u00a8<\/span> statements of intent and subject matter of the subcontracting, or engagement of subcontractors, including a list of subcontractors with detailed information (name, address, percentage of participation, etc.).<\/o_p><\/span><\/span><\/p>\n

8. Validity of the offer<\/o_p><\/span><\/b><\/span><\/p>\n<\/div>\n

The validity period of the tender is 90 days from the date of the public opening of tenders.<\/o_p><\/span><\/p>\n

Article 14 Deadline for making a decision on the selection of the most favourable offer <\/o_p><\/span><\/b><\/span><\/p>\n<\/div>\n

Deadline <\/span>Payment is due within 30 days of the interim and final situations being approved by the Client.<\/o_p><\/span><\/span><\/p>\n

The method of payment is to the contractor's current account.<\/o_p><\/span><\/p>\n

\u00a8<\/span>  Financial Security for Public Procurement Contracts<\/o_p><\/b><\/span><\/span><\/p>\n

The bidder whose bid is selected as the most advantageous is obliged to provide the procuring authority with:<\/o_p><\/span><\/p>\n

\u00a8<\/span> a bond for the proper execution of the contract in the amount of 5% of the contract value, with a duration of at least 30 (thirty) days beyond the completion deadline for the works.<\/o_p><\/span><\/span><\/p>\n

\u00a8<\/span> <\/span>guarantee to remedy the defect within the guarantee period <\/span>to the amount of 5% of the contract price, by which it unconditionally and irrevocably guarantees the full and diligent performance of the contractual obligations for the duration of the guarantee period,<\/span> with a period of 30 days longer than the guarantee period.<\/o_p><\/span><\/span><\/p>\n
