a) Mandatory requirements <\/o_p><\/span><\/span><\/b><\/p>\n<\/div>\n

<\/span><\/span><\/i><\/b><\/p>\n

Only a tenderer who:<\/o_p><\/span><\/p>\n

1) is entered in the register with the authority competent for the registration of business entities;<\/o_p><\/span><\/p>\n

2) has duly fulfilled all its tax and social security contributions obligations in accordance with the law, or the regulations of the state in which it is established;<\/o_p><\/span><\/p>\n

3) prove that he or his legal representative has not been convicted by a final judgment for any of the criminal offences of organised crime involving corruption, money laundering and fraud;<\/o_p><\/span><\/p>\n

4) has a permit, licence, approval or other authorisation to carry out the activity that is the subject of the public procurement, if this is required by a special law.<\/o_p><\/span><\/p>\n

<\/span><\/p>\n

The conditions of paragraph 1 of this point do not apply to natural persons: artists, scientists and cultural creators.<\/o_p><\/span><\/p>\n

Proof of compliance with mandatory requirements<\/o_p><\/span><\/b><\/p>\n<\/div>\n

<\/span><\/p>\n

Compliance with the mandatory requirements is demonstrated by providing:<\/o_p><\/span><\/p>\n

<\/span><\/p>\n

1) proof of registration with the competent authority for the registration of business entities, with details of the bidder's authorised representatives;<\/o_p><\/span><\/p>\n

2) a certificate issued by the tax authority confirming that all tax and contribution obligations have been duly declared, calculated and paid up to 90 days prior to the date of the public tender opening, in accordance with the regulations of Montenegro, or the regulations of the country in which the tenderer is headquartered;<\/o_p><\/span><\/p>\n

3) a certificate from the competent authority issued on the basis of the criminal record, which must not be older than six months as of the date of the public opening of bids;<\/o_p><\/span><\/p>\n

4) dokaza o posjedovanju va\u017ee\u0107e dozvole, licence, odobrenja, odnosno drugog akta izdatog od nadle\u017enog organa i to: Naru\u010dilac se obratio nadle\u017enom organu Agenciji za za\u0161titu \u017eivotne sredine Crne Gore, koja se aktom broj: 05-D2572\/2 od 12.11.2015.godine izjasnila:\u201d Ponu\u0111a\u010d je du\u017ean ukoliko se radi o uvozu novih stacionarnih akumulatorskih olovnih baterija da podnese samo prijavu o po\u010detku obavljanja djelatnosti Agenciji za za\u0161titu \u017eivotne sredine, iz koje nastaje obaveza obra\u010duna i pla\u0107anja posebne naknade. Nakon toga Agencija dostavlja Poreskoj upravi prijavu djelatnosti u roku od tri dana od dana podno\u0161enja prijave. Pitanje javne nabavke odre\u0111enih proizvoda, me\u0111u kojima su i proizvodi koje ste u Va\u0161em aktu naveli, \u0161to se ti\u010de obaveza nabavke iz uvoza regulisano je Uredbom o bli\u017eim kriterijumima, visini i na\u010dinu pla\u0107anja posebne naknade za upravljanje otpadom.\u201d<\/o_p><\/span><\/p>\n

\u00a8<\/span> a relevant bank statement, certificate or declaration of the bidder's financial capacity;<\/o_p><\/span><\/p>\n

Fulfilling the conditions of professional, technical and personnel qualifications in the public procurement procedure goods<\/span> is proven by providing the following evidence:<\/span><\/b><\/o_p><\/span><\/p>\n

\u00a8<\/span> lists of the main deliveries carried out in the last two years, with values, dates and recipients, together with certificates of deliveries issued by the customer or, if the certificates cannot be provided, for reasons not attributable to the bidder, only a declaration by the bidder regarding the deliveries carried out, stating the reasons why they are unable to provide the certificates;<\/o_p><\/span><\/p>\n

8. Validity of the offer<\/o_p><\/span><\/b><\/p>\n<\/div>\n

The bidder whose bid is selected as the most advantageous is obliged to provide the procuring authority with:<\/o_p><\/span><\/p>\n
