VII Conditions for participation in the public procurement procedure

a) Mandatory requirements

Only a tenderer who:

1) is entered in the register with the authority competent for the registration of business entities;

2) has duly fulfilled all its tax and social security contributions obligations in accordance with the law, or the regulations of the state in which it is established;

3) prove that he or his legal representative has not been convicted by a final judgment for any of the criminal offences of organised crime involving corruption, money laundering and fraud;

The conditions of paragraph 1 of this point do not apply to natural persons: artists, scientists and cultural creators.

Proof of compliance with mandatory requirements

Compliance with the mandatory requirements is demonstrated by providing:

1) proof of registration with the competent authority for the registration of business entities, with details of the bidder's authorised representatives;

2) a certificate issued by the tax authority confirming that all tax and contribution obligations have been duly declared, calculated and paid up to 90 days prior to the date of the public tender opening, in accordance with the regulations of Montenegro, or the regulations of the country in which the tenderer is headquartered;

3) a certificate from the competent authority issued on the basis of the criminal record, which must not be older than six months as of the date of the public opening of bids;

Fulfilling the conditions of professional, technical and personnel qualifications in the public procurement procedure goods is proven by providing the following evidence:

¨ lists of the main deliveries carried out in the last two years, with values, dates and recipients, together with certificates of deliveries issued by the customer or, if the certificates cannot be provided, for reasons not attributable to the bidder, only a declaration by the bidder regarding the deliveries carried out, stating the reasons why they are unable to provide the certificates;

¨ Measure for the assurance of the quality management system:

Regular ISO System Resertification equipment manufacturerISO 9001- An international standard that contains requirements for a quality management system in a business organisation, which the organisation must meet to align its operations with internationally recognised norms. If the goods in question are offered by multiple manufacturers, a certificate must be provided from each equipment manufacturer.

¨ other certificates which have been issued by a conformity assessment body whose competence is recognised, and which, by means of a clearly defined reference to the relevant specifications or standards, confirm the suitability of the goods:

Certificates (attestations) of type testing for all types of clamps and insulating chains from the specification, in accordance with IEC 61284/97, issued by an accredited laboratory. For the connecting equipment (insulating chains), provide test certificates in accordance with IEC 61284/97 for the testing of the complete chain assemblies specified. in the specification

¨ Statements of intent and subject matter of the subcontracting, with a list of subcontractors, or sub-contractors, including their full details (name, address, percentage share, etc.).

8. Validity of the offer

Period The validity of the offer is 90 days from the date of the public opening of bids.

The bidder is required to provide an unconditional, first-demand tender bond in the amount of 2% of the estimated value of the public procurement, as a guarantee of their commitment to the tender during the validity period of the tender and 5 on the day after the offer expires.

X  Date and place of executiontermination of the contract

a) The contract shall be completed within 90 calendar days from the date of contract conclusion. (Deliver 60% of the goods (this applies to all items in the specification) within the first month and a half from the date of contract signing, and the remaining 40% within three months from the date of contract signing.)

b) The place of performance is the TS 110/35 kV Nikšić.

XI Language of the offer:

¨ The Montenegrin language and the other language which is in official use in Montenegro, in accordance with the Constitution and the law.

English is also acceptable for the Bidder for the parts of the tender relating to:

¨ Technical documentation (Certificateand ISO 9001 other certificates which have been issued by a conformity assessment body whose competence is recognised, and which, by means of a clearly defined reference to the relevant specifications or standards, confirm the suitability of the goods.

12. Criteria for the selection of the most favourable offer:

XIII Time and place for submission of tenders and public opening of tenders

Offers are submitted on weekdays from 08:00 to 14:00 hours, up to and including 21 November 2016. 11:30 hour

In accordance with Article 90, paragraph 2 of the Public Procurement Law, the Client has decided to shorten the deadline for submitting tenders to 22 days for the following reasons:

Installation of the missing connecting equipment is necessary for the implementation of the previously signed Contract No. 8490 of 08.07.2015 for the reconstruction of the 110/35 kV Nikšić substation—sanation of the reinforced concrete portals, which does not include the procurement but does include the installation of this equipment.

The works under the aforementioned Contract are in progress. The works are being carried out under a total voltage-free condition which has been agreed at the level of the surrounding power systems, and as such is strictly defined and cannot be changed.

A portion of the works in question must be carried out before the Krnovo wind farm is connected to Montenegro's electricity grid.. The execution of the works after the commissioning of VE Krnovo into the Montenegrin electricity grid would render its operation and the marketing of the generated energy impossible, which would result in enormous financial costs for the CGES.

Offers may be submitted:

¨ by recommended delivery with return address at 18 Bulevar Svetog Petra Cetinjskog, Podgorica.

The public opening of bids, which may be attended by authorised representatives of the bidders with an attached power of attorney signed by an authorised person, will be held on 21 November 2016 at 12:00 noon, at the premises of the Montenegrin Electricity Transmission System at the address 18 St. Petar Cetinjski Boulevard, Podgorica.

Article 14 Deadline for making a decision on the selection of the most favourable offer

The decision on the selection of the most favourable offer will be made within 90 days from the date of the public opening of bids.

XV Other data and conditions relevant to the conduct of the public procurement procedure

Deadline and method of paymentchange

The payment term is: advance paymenta payment of 20% of the total contract value within 30 calendar days from the date of the contract, and the remaining 80% within 30 calendar days from the date of signing Record of the quantitative and qualitative receipt of goods by the Client.

The method of payment is to the Supplier's current account.

¨  Financial Security for Public Procurement Contracts

The bidder whose bid is selected as the most advantageous is obliged to provide the procuring authority with:

-          a performance bond in the amount of 5% of the contract value with a validity period 30 (thirty) days longer than the agreed delivery period for the entire delivery of goods

-          A guarantee for the refund of the advance payment in the amount paid, with a validity period. thirty  of days longer than the agreed deadline for fulfilling contractual obligations
